Terms of Service

1. Agreement to these terms

PumpPal is developed by Justin Sinnard under the name Sinnard Technologies ("PumpPal," "we," "us," or "our"). By downloading, accessing, or using PumpPal, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

You must be legally able to enter into this agreement. If you use PumpPal for an organization, you represent that you have authority to bind that organization.

2. The PumpPal service

PumpPal provides tools for building workout plans, logging physical activity, timing rest periods, recording progress, and optionally syncing information across devices. Features may differ by device, operating system, region, app version, or purchase status.

We may improve, add, change, suspend, or discontinue features. We will use reasonable care to avoid unnecessary disruption, but we do not guarantee that every feature will always be available.

3. Health and safety

PumpPal does not provide medical advice, diagnosis, treatment, or personalized professional training. Workout plans, exercise descriptions, estimates, reminders, and other content are provided for general informational purposes.

Exercise involves risk. Consider consulting a qualified healthcare professional before beginning or changing an exercise program, especially if you have an injury, medical condition, are pregnant, or have concerns about your ability to exercise safely. Stop exercising and seek appropriate help if you experience pain, dizziness, shortness of breath, or other concerning symptoms.

You are responsible for choosing appropriate exercises, equipment, resistance, intensity, and technique and for using equipment safely.

4. Accounts and security

Many core features can be used locally without an account. An account may be required for cloud sync, purchase verification, or other connected features. You agree to provide accurate information, protect your credentials, and promptly notify us if you suspect unauthorized access.

You are responsible for activity performed through your account unless prohibited by law. Do not share access in a way that compromises the service or another person's information.

5. Purchases, pricing, and refunds

PumpPal may offer free features, advertising-supported features, and a Lifetime upgrade. Current pricing and included features are shown before purchase. Prices, promotions, and available purchase options may change prospectively, but changes do not remove an entitlement you already purchased except where required to protect the service, comply with law, or address misuse.

Apple or Google processes in-app purchases under its own terms. Taxes, billing, refunds, and payment disputes are generally handled by the store where you made the purchase. "Lifetime" refers to access for the supported lifetime of the PumpPal product and associated services; it does not guarantee that every existing feature or third-party service will remain available forever.

6. Your content and data

You retain ownership of workout logs, plans, photos, measurements, feedback, and other content you provide. You give us a limited permission to host, process, transmit, and display that content only as reasonably necessary to operate features you request, such as cloud sync or support.

You represent that you have the rights needed to provide your content and that it does not violate law or another person's rights. You are responsible for keeping appropriate backups of information important to you. Our handling of personal information is described in the Privacy Policy.

7. Acceptable use

You may not misuse PumpPal. In particular, you may not:

• Use the service for unlawful, fraudulent, harmful, or abusive activity.
• Attempt to gain unauthorized access to accounts, systems, or data.
• Interfere with service operation, security controls, rate limits, or other users.
• Upload malware or content that violates privacy, intellectual-property, or other rights.
• Reverse engineer, scrape, copy, resell, or exploit the service except where applicable law expressly permits it.

8. PumpPal ownership

PumpPal, including its software, design, branding, text, graphics, and other service content, is owned by us or our licensors and is protected by applicable laws. Subject to these terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use PumpPal for its intended purpose.

If you send suggestions or feedback, you allow us to use them without restriction or compensation, while we remain responsible for how we use them.

9. Third-party services

PumpPal may rely on or link to services provided by Apple, Google, hosting providers, analytics providers, advertising providers, or other third parties. Their products and policies are outside our control. We are not responsible for third-party services, content, availability, or actions.

10. Disclaimers

To the fullest extent permitted by law, PumpPal is provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation, specific fitness results, data preservation, or that content will be accurate or suitable for every person.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, PumpPal and Sinnard Technologies will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, or business interruption arising from your use of or inability to use the service.

Our total liability for claims relating to PumpPal will not exceed the greater of the amount you paid for PumpPal during the 12 months before the claim or US $50. These limitations do not apply where liability cannot legally be limited or excluded.

12. Suspension and termination

You may stop using PumpPal at any time. We may suspend or terminate access if you materially violate these terms, create risk or legal exposure, or threaten the security or operation of the service. Where reasonable, we will provide notice and an opportunity to address the issue.

Sections that by their nature should survive termination—including ownership, disclaimers, limitations of liability, and dispute provisions—will continue to apply.

13. Governing law

These terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles. Any dispute that is not eligible for small-claims court will be brought in the state or federal courts serving Winnebago County, Wisconsin, unless applicable consumer law requires otherwise.

14. Changes to these terms

We may update these terms as PumpPal changes. We will post the revised terms and update the effective date. If a change is material, we may provide additional notice where appropriate. Continued use after updated terms take effect means you accept them, to the extent permitted by law.
